Arbitration is a private process in which each party’s lawyer argues their client’s position to the arbitrator (typically an attorney experienced in family law). The process often occurs in a lawyer’s conference room and, although the arbitrator’s decision is binding on the parties, the process itself is more informal than trial. Witnesses testify and other evidence is entered into the record to help the arbitrator make his or her decision. After the arbitration concludes, the arbitrator considers the evidence and issues a written decision and final orders enter.
