
There are typically four stages in family law litigation:
- The initial filing and service by one party upon another party;
- An appearance in court typically two weeks later to litigate temporary orders. These orders – including where the children will live, how much child support/maintenance will be paid, the allocation of debts, payment of attorney’s fees – often remain in place until settlement or trial.
- A discovery process where legally relevant financial and personal information is gathered from both parties; and,
- Settlement or trial.
Litigation can be very intimidating and confusing – especially when your family’s future and your financial future are at stake. Many times people need someone who is familiar with the local players and the process to assist them. Unfortunately, litigation is necessary in many family law situations, including those including severe mutual distrust and anger, domestic violence, substance abuse and mental health issues.
